Oklahoma SB2028 Advances Raw Milk Sales, Advertising, Labeling Requirements

Oklahoma’s Senate Bill 2028 has cleared both chambers of the state legislature and is awaiting the governor’s signature. The bill amends the Oklahoma Milk and Milk Products Act to expand on-farm raw milk sales, explicitly permit advertising of raw milk, allow farmers to produce and sell raw milk cheese, and require state-produced warning labels on all raw milk containers.

Legislative Progress

SB2028 passed the Oklahoma Senate on third reading March 16, 2026, by a vote of 47 to 0. The House Agriculture Committee passed it 8 to 0 on April 6, and the House Committee on Energy and Natural Resources Oversight issued a Do Pass recommendation on April 13. The bill carries an emergency clause, meaning it takes effect immediately upon the governor’s signature rather than on a delayed effective date.

The bill was authored by Senators Wingard, Bullard, Murdock, Deevers, Jett, and Frix in the Senate, with Rep. David Hardin carrying it in the House.

What the Bill Does

Incidental sales volume increase. Under current Oklahoma law, incidental on-farm sales of raw milk are capped at 100 gallons per month. SB2028 raises that ceiling to 1,500 gallons per month. The bill also extends the incidental sales exemption explicitly to raw milk products, not just raw milk itself.

Raw milk cheese. The bill adds a provision clarifying that the Oklahoma Milk and Milk Products Act does not prohibit a farmer from making cheese using milk or cream produced on that farm.

Advertising. Existing law permitted advertising for goat milk incidental sales only. SB2028 adds a new provision stating that the Act shall not be construed to preclude advertising of the sale of ungraded raw milk and raw milk products broadly.

Warning labels. Section 2 of the bill creates a new section of law (Section 7-413.1 of Title 2) requiring a visible warning label and fill date on every container of raw milk or raw milk products sold, offered for sale, or distributed. The Oklahoma Department of Agriculture, Food, and Forestry (ODAFF) is directed to produce a standard warning label and make it available on its website. The bill specifies the label must include statements substantially similar to:

Raw (unpasteurized) milk and raw milk products are not licensed, regulated, or inspected and may contain harmful bacteria that can cause serious illness.

Pregnant women, unborn babies, children, the elderly, and people with weakened immune systems are at higher risk of serious illness from consuming raw milk.

ODAFF is authorized to promulgate rules on label size, placement, and content. It is a violation of the Act to sell, offer, or serve raw milk without the required label affixed to the container.

Violations. SB2028 adds two new violations to the existing list in Section 7-413: selling raw milk without notifying the consumer that the product is not licensed, regulated, or inspected; and selling raw milk without the new labeling requirement. All existing violations are renumbered accordingly.

Current Oklahoma Raw Milk Law
